2019 Ontario allowable rent increase!
Ontario Government sets 2019 Rent Increase at 1.8%
On July 4, 2018 the Government of Ontario announced that residential rent increases between January 1 and December 31, 2019 will be capped at a maximum of 1.8%.
As in previous years, any increase exceeding that amount must receive approval from the Landlord and Tenant Board.
The annual provincial guideline applies to most rental units that fall under Ontario’s Residential Tenancies Act, but does not include: vacant units, social housing, or nursing homes.
Tenants and landlords are reminded that tenants must receive written notice of any rent increase at least 90 days before it takes effect. In most cases, rent can be increased 12 months after the last rent increase, and/or 12 months after a tenant first moves in.
Historically, the annual rent increase guideline is calculated to reflect changes in Ontario’s Consumer Price Index.
During the three decades since this system was initiated to help keep provincial housing costs more affordable, the highest maximum increase of 6.0% occurred in 1992 and the lowest, 0.7%, was in 2011.

Rental Fairness Act, 2017: What You Need to Know
July 6, 2018 — We wrote in the past about recent legislative changes to the rental housing system in Ontario. As a follow-up, this article should assist in providing you with what you need to know about the Rental Fairness Act and its implications for your clients.
<www.mah.gov.on.ca/page137.aspx> The Rental Fairness Act, 2017 is a piece of legislation introduced on May 30, 2017 to amend the Residential Tenancies Act, 2006. This new legislation expands rent control to all private rental units, including those first occupied on or after November 1, 1991 and sets an annual cap on rent increases tied to the Consumer Price Index. The legislation also introduces additional protection for tenants, including enabling a standard lease and protecting tenants from eviction due to abuse of the “landlord’s own use” provision.
Expanding Rent Control As part of the Fair Housing Plan, the Ontario government <news.ontario.ca/mho/en/2017/05/ontario-protecting-tenants-from-unfa ir-rent-increases.html> expanded rent control to most private rental units in the province. As such, effective April 20, 2017, landlords in Ontario cannot increase the rent for most private rental units built on or after Nov. 1, 1991 by more than the amount set by the rent increase guideline. The annual cap for 2018 is 1.8 per cent. Once a unit is vacant, landlords can legally raise the rent without limit.
The Landlord and Tenant Board can approve a <www.sjto.gov.on.ca/documents/ltb/Landlord%20Applications%20&%20Instr uctions/L5.pdf> rent increase above guidelineof up to three percentage points above the cap for capital expenses (not including normal ongoing maintenance), unusually high increases in municipal taxes and charges, and the cost of security services. However, as of January 1, 2018, landlords won’t be able to apply for above guideline rent increases for utility costs or in buildings with outstanding elevator work.
Standard Lease Effective April 30, 2018, landlords of most private residential rental units (single and semi-detached houses, apartment buildings, condos, and secondary units) – from individual landlords to property management companies – must use the standard lease template for all new leases. A standard lease is not required for tenancies that have special rules or partial exemptions under the Rental Tenancies Act, including care homes, mobile home parks, land lease communities, social and supportive housing, co-operative and transitional housing. Ending a Lease To protect tenants from eviction due to abuse of the “landlord’s own use” provision which saw some landlords terminate a lease only to turn around and re-lease the unit to a different tenant for a higher rent, the government introduced three provisions related to when a landlord terminates a lease for “own use”:
1. only landlords who are individuals can terminate a lease for “own use,” not corporations; 2. landlord is now required to demonstrate that they need the unit for a minimum of one year; 3. tenant must be compensated for one month’s rent for lease termination, or be offered another acceptable rental unit; 4. if landlord acts in bad faith, they could face a fine of up to $25,000.

From installing screen reader devices, hearing induction loop systems, automated door openers, constructing a universally designed office or retrofitting a washroom with an accessible toilet, grab bars and taps, the Enabling Accessibility Fund works to enable Canadians with disabilities to participate in their community and the economy.
To be considered eligible for funding, projects must be directly related to removing barriers and increasing accessibility for people with disabilities in Canadian communities. All projects must also meet the specific eligibility criteria identified in calls for proposals, including support from the community.
